In what must be considered a setback for the prosecution, one of the state’s primary witnesses against two men accused of a 2009 murder died of an apparent heart attack on Monday night. Robert Moccia, 52, the brother of murder suspect Paul Moccia, of Dedham, was set to testify that his brother enlisted his help to drive a pickup truck to Framingham one night in March 2009.

A Newton man with a long history of driving offenses was arraigned this morning on motor vehicle homicide charges stemming from the death of Catholic Memorial student Francis McInerney on VFW Parkway this summer, Suffolk County District Attorney Daniel F. Conley said in a press release.

Zyoma Wasserman, 48, of Dedham is expected to face arraignment Wednesday in West Roxbury District Court on motor vehicle homicide charges in connection with the death of Catholic Memorial student Francis McInerney, 17, this summer, according to a press release from the Suffolk County District Attorney’s Office.
Murder suspects Paul Moccia of Dedham and Daniel Bradley of Westwood, accused of killing Angel Ramirez in 2009, had their trials separated in 2011, but the trials themselves did not take place.
