Police said they arrested Brian Whalen, 24, of 297 West St. in Needham, on charges of drunken driving, disorderly conduct, and resisting arrest after he did not heed officers’ instructions outside Kings early on Saturday, Jan. 23.
Lt. Robert Nedder said police responded to the Legacy Place nightspot at about 12:45 a.m. after security said there was an issue with a drunk man coming out of Kings. Whalen, who had been asked to leave by a manager, was standing in front of the building and being offensive to patrons as they left the building, Nedder said. As they exited, Whalen yelled and swore at them, and kept being rude and offensive to people after the officers told him to please keep quiet, Nedder said.
The officers told Whalen to wait away from Kings for his friends, and Whalen said he would wait by his friend’s truck, Nedder said. Then, according to Nedder, Whalen walked over to the truck, got inside, started it up, and drove in the Legacy Place parking lot, stopping about 50 yards in front of Kings. As the officers approached him, he jumped from the driver’s seat to the passenger seat, locked the doors, and shut off the ignition, Nedder said.
After Whalen unlocked the doors, he claimed that he hadn’t been driving, Nedder said. Whalen resisted officers’ efforts to place him under arrest outside the truck, pulling his hands away, but after a brief struggle they put him under handcuffs, Nedder said.
At his arraignment in Dedham District Court Jan. 25, Whalen “pleaded out” to the drunken driving charge, which was continued without a finding for one year, Nedder said. Whalen must enter an alcohol treatment program, lost his driver’s license for 45 days, and has to pay associated fees, Nedder said. The other two charges were dismissed as part of the plea, he added.
